The privacy protection procedures outlined in this document (the Privacy Policy) will apply to Personally Identifiable Information (as defined below) that Marcom S.r.l. acquires in relation to all products, services, and the website (“the Site”). By choosing to consult the Site, the user agrees to adhere to the terms and conditions of this Privacy Policy. Otherwise, the user is invited not to access or make any use of the Site. Marcom S.r.l. reserves the right to modify this Privacy Policy without prior notice. The date of the last update to the Privacy Policy is indicated in the “Last Updated” caption at the top of this page. Any changes to this Privacy Policy will take effect upon publication of the amended policy on the Site. Use of the Site following such changes constitutes acceptance of the Privacy Policy in effect at that time.
User's Personally Identifiable Information may be acquired and collected by Marcom S.r.l., as well as used by Marcom S.r.l. This Privacy Policy outlines the user's Personally Identifiable Information collected by Marcom S.r.l., as well as the methods of processing and/or disclosure of the same.

Note on Website Use by Children: The content of the Site is not intended for users under thirteen (13) years of age. Therefore, such users are requested not to transmit any personally identifiable information through the Site.

  1. What information does Marcom S.r.l. collect about me?

    1. Personally Identifiable Information
      “Personally Identifiable Information” (or “PII”) is information that allows for the identification of the user’s identity. Marcom S.r.l. may use various systems to acquire PII, among which the two most common are through registration to the Site or its personalization, or during registration or subscription for certain products or services. In some cases, no PII is required for browsing the Site and using some of the available services. The PII requested may vary depending on the product, service, or Site accessed or used by the user. Generally, Marcom S.r.l. only requests information such as personal details, email address, phone numbers, and fax numbers. However, financial information, including, for example, the user's bank account or credit card number, may be requested to verify identity and enable payment for any purchases. In cases where the user contacts us, Marcom S.r.l. may retain a record of correspondence or communications, including any PII exchanged. Information about the methods used by the user to contact Marcom S.r.l. may also be recorded. Such PII may include the user's email address, the sender's email address indicated in messages sent by the user, the sender's address on any written communication delivered to Marcom S.r.l., the number indicated on any fax, or the phone number used by the user during their calls. Sometimes the user may receive a personal identifier (ID) or may be invited to create one, just as they may be invited to provide a personal password through which to take advantage of all products and services offered by the Site.

      In addition to the PII acquired during registration, Marcom S.r.l. may ask the user to provide PII in other circumstances, for example, when making a purchase or using a Site service, or participating in a survey or promotion, or reporting problems related to the functioning of the Site or its services. Generally, the more specific the information transmitted by the user, the easier it will be for Marcom S.r.l. to customize the service offered to the user.

    2. Non-Personally Identifiable Information

      “Non-Personally Identifiable Information” (or “Non-PII”) is aggregated, demographic, and other information that does not reveal the user’s personal identity. Marcom S.r.l. and its service providers collect Non-PII that does not identify the user through the use of “cookies,” environmental variables, and other technologies, as well as by leveraging communications with the user and information voluntarily provided by the user to Marcom S.r.l.
      Cookies: A cookie is a small data packet transmitted to a browser by a web server, which is then saved on the user's computer hard drive. If you do not wish for information to be collected through the use of cookies, most browsers allow you, with a simple procedure, to automatically refuse cookies or to choose whether to reject or accept the transmission of one or more specific cookies from a particular website to your computer. However, by refusing the transmission of all cookies, the user will not be able to use Marcom S.r.l. services that require a registration or personalization procedure. By accepting cookies from Marcom S.r.l. or its service providers, the user authorizes the saving of cookies on the computer in use.       Environmental Variables: Marcom S.r.l. and its service providers may also collect certain environmental variables, including MAC address, computer type (Windows or Macintosh), screen resolution, operating system name and version, browser type and version in use. These environmental variables are collected by most browsers and may be used to optimize the user's experience on the Site.
      Communications: Marcom S.r.l. and its service providers may collect Non-PII related to the systems used by the user for communications with Marcom S.r.l., including national domain, language selected for displaying order forms or other documents, browser type used, currency chosen for displaying prices, where available, and the use of a secure or unsecured web page. Furthermore, upon registration of a product or service, or a support request generated by the Marcom S.r.l. product or service in use, or with the transmission of an error report, Marcom S.r.l. and its service providers may acquire information, including request codes, activation codes, product release number, version, language, graphic configuration, driver name and version, and other Non-PII.

      Information voluntarily provided by the user: Marcom S.r.l. also acquires other Non-PII, including, for example, a keyword, a company name, title, location, the user's industry, as well as information associated with security questions and answers, provided that the user voluntarily decides to provide such information. The aforementioned information is considered Non-PII, as it does not allow for the personal identification of a user, unless used in conjunction with PII. Furthermore, Marcom S.r.l. may combine PII in such a way that the final result does not allow for the identification of any user of the Site; for example, it may use PII to determine the percentage of users who have a certain telephone area code. For the purposes of this Privacy Policy, such aggregated information is considered Non-PII.

    3. IP Addresses and Serial Numbers

      The Internet Protocol address (IP address) is a number automatically assigned to the computer in use by the Internet Service Provider (ISP). The IP address, computer name, and serial number (or the old serial number) of a product or service purchased from the Marcom S.r.l. website are automatically recorded in Marcom S.r.l.'s server log files when the user visits the Site (along with the time(s) of the visit(s) and the page(s) visited), registers on the Site, and/or sends an error report to Marcom S.r.l.

  2. How does Marcom S.r.l. use my information?

    1. Personally Identifiable Information
      Marcom S.r.l. may use a user's Personally Identifiable Information for the following purposes:

      • Personalized experience. By acquiring Personally Identifiable Information, one of Marcom S.r.l.'s main objectives is to provide the user with a personalized experience of the Site and/or the products and services offered. This includes personalization services (e.g., customizable content by both the user and Marcom S.r.l.), interactive communications (e.g., surveys and email contacts with Marcom S.r.l. representatives), e-commerce services, and numerous other services, many of which are free of charge.

      • Fulfilling requests. Personally Identifiable Information may be used by Marcom S.r.l. and its service providers to respond to user requests, fulfill the purpose for which it was provided (e.g., process and fulfill requests for products, services, or technical support) and for administrative purposes (e.g., customer service). Furthermore, Marcom S.r.l. may use Personally Identifiable Information to ensure the user is directed to the correct Site, product, and/or service.

      • Communications. Once registered, Marcom S.r.l. may use the user's Personally Identifiable Information to communicate information related to products or services offered by Marcom S.r.l., recommend Marcom S.r.l. products and services, and allow them to take advantage of the features available with them. If the user later changes their mind and no longer wishes to receive such marketing communications from Marcom S.r.l., they can always request to be excluded from the distribution of such communications by following the procedure outlined in point 9.7 below. Marcom S.r.l. may from time to time, at its sole discretion, use Personally Identifiable Information to send important information related to the Site or to any amendments to the terms, conditions, and regulations and/or to transmit other administrative and/or operational communications to the user. Since these communications may be important for the use of the Site, as well as the products or services offered therein, the user does not have the right to deny consent for the transmission of such operational communications.

      • Verification and delivery. Personally Identifiable Information provided by the user during the product registration or service subscription process will also be used by Marcom S.r.l. to identify the user as an authorized user of a Marcom S.r.l. product or service, as well as to transmit to the user the authorization code or password necessary to enable Marcom S.r.l. to provide the user with the product or service described in the relevant documentation.

      • Promotions. Personally Identifiable Information acquired within the framework of voluntary participation programs, including surveys, promotions, and contests (the “Promotions”) may be subject to separate or supplementary processing. In case of differentiated processing conditions, details relating to the use of this PII will be outlined in the specific terms and conditions or regulations of the aforementioned Promotions. Marcom S.r.l. may, for example, share PII provided in relation to the Promotions with relevant external sponsors (regardless of whether such Promotions are hosted on the Site or not) or process the information in accordance with the regulations applicable to the Promotions. Users are invited to carefully read, from time to time, the specific terms and conditions or regulations of such Promotions, as they may differ from what is provided in this Privacy Policy. To the extent that such terms and conditions or regulations regarding the processing of user's PII differ from the content of this Privacy Policy, such terms and conditions or regulations shall prevail.

      • Purchases. When the user makes a purchase from or through the Site, Marcom S.r.l. may use Personally Identifiable Information for the purpose of fulfilling the order.

      • Feedback. Personally Identifiable Information provided directly by the user on the Site may be combined with other PII and public information about the user, or with other PII or information relating to the user otherwise acquired by Marcom S.r.l., for the purpose of targeting advertising and personalizing the content offered on the Site.

      • Compliance with Marcom S.r.l.'s Terms and Conditions. Marcom S.r.l. also uses PII, including IP addresses and other information, to facilitate the recognition of unregistered or illegal versions of Marcom S.r.l. products and services, or when Marcom S.r.l. believes there has been a violation of law or other interference with or violation of the rights and property of Marcom S.r.l. and other parties, and to take appropriate measures.

      • Internal administrative purposes. Marcom S.r.l. may use the user’s Personally Identifiable Information for internal administrative purposes, such as, by way of example only, data analysis activities, auditing, business continuity, disaster recovery, data backup and replication, and so on.

      • Career opportunities. The user may use the Site to transmit PII in connection with job postings. All PII transmitted in this way will be subject to a separate Privacy Policy that applies to such PII and not to this Privacy Policy.

    2. Non-Personally Identifiable Information

      Non-Personally Identifiable Information does not allow for the personal identification of a user; therefore, Marcom S.r.l. may use it for any purpose. The Non-PII acquired may be used, for example, to improve understanding of registered users, through aggregate analysis of demographic data, or of users' interests or behaviors. Furthermore, Marcom S.r.l. reserves the right to share Non-PII, which does not allow for personal identification of the user, with third parties for any purpose.

      In some cases, Marcom S.r.l. may combine Non-PII with PII (e.g., the user's name with their domicile). In such a case, the combined information will be treated as PII under this policy, as long as it continues to be combined and used as such.

    3. IP Addresses and Serial Numbers

      Marcom S.r.l. uses IP addresses, computer names, and serial numbers for purposes such as, but not limited to, calculating the degree of use of the Site, as well as its products and services, or to facilitate the diagnosis of problems related to servers, products, and services, and to administer the Site, products, and services and resolve any problems. Marcom S.r.l. may also use IP addresses, computer names, and serial numbers for system administration and to transmit aggregated information to its advertisers. Marcom S.r.l. also uses IP addresses, computer names, and serial numbers to facilitate the identification of unregistered or illegal versions of Marcom S.r.l. products and services, and to take appropriate measures in this regard. Finally, Marcom S.r.l. uses and communicates IP addresses, computer names, and serial numbers for all purposes illustrated in point 2(a) above and point 3 below. It should be noted that Marcom S.r.l. treats IP addresses, computer names, serial numbers, and related information as Non-Personally Identifiable Information (and may therefore use and disclose it as it uses and discloses Non-Personally Identifiable Information), except where applicable laws prescribe otherwise.

  3. With whom does Marcom S.r.l. share my Personally Identifiable Information?

    • With business partners and companies with whom it has strategic alliances. When the user transmits Personally Identifiable Information to Marcom S.r.l. for the purchase of a product or service from a partner or a company with whom Marcom S.r.l. has professional relationships, Marcom S.r.l. is required to share such PII with the partner/company to allow for the fulfillment of the order(s), as well as the shipping, provision, maintenance, renewal, or support of the products or services requested by the user, who may also be contacted by the partner/company for any of these purposes. From time to time, Marcom S.r.l., if the user transmits PII, is authorized to share such PII with any partner or company with whom it has such professional relationships for any of the purposes indicated above in this Section and/or for any of the purposes illustrated in point 2 above. Marcom S.r.l. will require such partner/company to agree to apply reasonable safeguards for the protection of PII and to use PII only for the purposes for which it is provided. Furthermore, Marcom S.r.l. has the right to combine PII with other data and share such data with its partners.
      MARCOM S.r.l. DOES NOT GUARANTEE NOR ASSUMES ANY RESPONSIBILITY FOR THE USE OF PERSONALLY IDENTIFIABLE INFORMATION RELATING TO THE USER BY SUCH PARTNERS, COMPANIES AND/OR RESELLERS.

    • Marketing relationships If the user chooses to transmit personal information, Marcom S.r.l. may share Personally Identifiable Information with third parties to enable them to send the user information relating to the products and services offered. If the user does not wish for their Personally Identifiable Information to be shared with third parties for marketing purposes, it is possible to deny consent for such sharing, as described in point 9.7 below.

    • Internal sharing within Marcom S.r.l.. The user’s Personally Identifiable Information may be shared by the Marcom S.r.l. organization for the purpose of providing the user with the ordered products, or the services for which they have registered, as well as to provide the user with information about the products or services offered.
      Marcom S.r.l. assumes responsibility for the processing of shared PII.

    • Special circumstances. Marcom S.r.l. may also use and/or disclose Personally Identifiable Information in other special circumstances, when there is reason to believe that the use and/or disclosure of such information is necessary to identify, contact or, if Marcom S.r.l. deems it necessary, take legal action (including any legal action initiated outside the user's country of residence) against anyone who violates the Terms of Service, end-user license agreements and/or intellectual property rights of Marcom S.r.l. The same criterion will apply if Marcom S.r.l. believes that an individual is harming or interfering (intentionally or unintentionally) with the rights or property of Marcom S.r.l., other users of a Marcom S.r.l. site or service, or anyone else who could be harmed by the activities undertaken by the individual. Marcom S.r.l. may disclose or access Personally Identifiable Information if it believes, in good faith, that applicable law (including that in force outside the user's country of residence) requires it to observe required legal procedures, respond to requests from competent authorities, including authorities outside the user's country of residence, and/or to pursue administrative or other purposes that, in Marcom S.r.l.'s judgment, are necessary to provide maintenance and support and optimize the products and services offered, protect Marcom S.r.l.'s operational activities, allowing it to avail itself of available remedies or to limit damages that Marcom S.r.l. could incur. This could also involve the exchange of Personally Identifiable Information with other companies and organizations aimed at protection against possible fraud and the reduction of any credit risks.

    • Service providers. Marcom S.r.l. occasionally uses the collaboration of companies and individuals to perform certain functions on its behalf. These include, by way of example, order fulfillment, postal and email shipments, removal of repeated Personally Identifiable Information from customer lists, verification of the accuracy of PII, data analysis, and the provision of related marketing support services, purchase processing, and credit card payment management. Marcom S.r.l. may share the user's PII with third parties to perform these functions.

    • Business Transfers. Due to the continuous development and constant expansion of products and services, Marcom S.r.l. may acquire or sell business units, products, or services. In the context of such operations, customer PII generally represents one of the assets subject to transfer. Therefore, in the event of a reorganization, merger, sale, joint venture, assignment, transfer or other disposition, complete or partial, of Marcom S.r.l.'s business units, assets (including, by way of example only, events related to bankruptcy or similar procedures), Marcom S.r.l. reserves the right to transfer to third parties any information acquired about Site users. Furthermore, in connection with any of the aforementioned operations, Marcom S.r.l. reserves the right to share PII relating to the user with its consultants and experts (e.g., accountants and lawyers).

  4. Wiki

    Marcom S.r.l. and its service providers may make available, through the Site, certain services (e.g., forums, chat groups, bulletin boards, and/or newsgroups, to name a few) on which information and materials can be posted. When accessing one of the aforementioned services available on a Site, it should be remembered that any information made available through these spaces becomes public domain and may be available to Site visitors and the general public. Furthermore, if the user decides to post information through such services, some Personally Identifiable Information (e.g., username) will also be accessible to other users. Marcom S.r.l. therefore invites users to exercise the utmost caution and discretion when deciding whether to disclose Personally Identifiable Information about themselves or other information on the Site. MARCOM S.r.l. DISCLAIMS ALL RESPONSIBILITY FOR THE USE OF ANY PERSONALLY IDENTIFIABLE INFORMATION VOLUNTARILY PUBLISHED THROUGH THE SITE.

  5. How do the services of Marcom S.r.l.'s partners or companies with whom Marcom S.r.l. has strategic alliances, or linked sites, work?

    Some products and services will be available through a Marcom S.r.l. Site, although provided by partners, either through their own websites or through websites shared with Marcom S.r.l. When ordering, using, or purchasing products or services from such partners, the user enters into an agreement with the partner, pursuant to which they provide their Personally Identifiable Information to the aforementioned partner and not to Marcom S.r.l. In these cases, this Privacy Policy does not apply, but rather the Privacy Policy of the partner providing the goods and services. Before entering into any agreements, we invite users to read and understand the policies applied by Marcom S.r.l.'s partners.
    Marcom S.r.l. may also provide links to a partner's or advertiser's site or to other sites different from the Site. Such linked sites are not under the control of Marcom S.r.l., which assumes no responsibility for the privacy practices or content of the aforementioned linked sites or any link present in a linked site. Such links are provided for convenience, and the inclusion of a link on a Site does not imply Marcom S.r.l.'s endorsement of the linked site. If the user provides Personally Identifiable Information through websites operated by third parties, the operation will take place on those websites (and not on the Site), and the PII transmitted will be collected by third-party sites and, therefore, will be governed by their respective Privacy Policies. The user is advised to inquire about the Privacy Policy of third-party sites and their related privacy protection practices and procedures.
    For any questions about the Privacy Policy of Marcom S.r.l.'s partners or third-party sites, users are invited to contact the aforementioned partners and sites directly.

    NOTE: THIS POLICY DOES NOT COVER THE PRIVACY AND PERSONAL INFORMATION PROCESSING PRACTICES OF THIRD PARTIES.

  6. Can I choose how my Personally Identifiable Information is used?

    If a user does not wish to receive marketing communications from Marcom S.r.l. or does not wish for Marcom S.r.l. to share their Personally Identifiable Information with affiliates or partners for the purpose of sending such information, it must be specified in the registration form, if the user is expressly asked to indicate their choice.
    Furthermore, if the user later no longer wishes to receive marketing communications from Marcom S.r.l. or if they prefer that their Personally Identifiable Information not be shared with Marcom S.r.l.'s affiliates and/or partners for marketing activities by such affiliates and/or partners, the user may change their preferences, revoke the transmission of marketing communications and/or the sharing of their data, by submitting a request.
    Alternatively, you can contact Marcom S.r.l. in writing at [email protected]). In all cases, the address provided at the time of registration must be included in the request.

    It is also necessary to clearly indicate which of the following options you wish to revoke:

    • transmission of marketing communications via email by Marcom S.r.l.

    • sharing of user's Personally Identifiable Information by Marcom S.r.l. with affiliates (including subsidiaries) for their marketing purposes

    • sharing of user's Personally Identifiable Information by Marcom S.r.l. with partners for their marketing purposes.

    Marcom S.r.l. will endeavor to the best of its ability to fulfill the user's request within a reasonably short time. If the user requests to revoke certain choices in the manner described above, Marcom S.r.l. will not be able to remove their Personally Identifiable Information from its databases or from those managed by external partners with whom such PII has been shared (i.e., to whom Marcom S.r.l. transmitted the user's PII at the time the revocation request is transmitted). If the user no longer wishes to receive marketing communications via email from third parties, they must contact them directly or use the opt-out procedures they have outlined in their respective privacy policy or within the marketing email communications themselves.

  7. I would like to update the Personally Identifiable Information I previously provided to Marcom S.r.l. What should I do?

    If registration is required for the site, the user can modify their profile by sending an email to the appropriate address specified in point 9 above, to review and modify their Personally Identifiable Information. In all cases, the address provided at the time of registration must be included in the request.

  8. Can I delete my accounts from the Marcom S.r.l. Website?

    Yes, the user can delete or deactivate an account on the Marcom S.r.l. Website at any time. However, by doing so, they will no longer be able to access any content of the deactivated Marcom S.r.l. service reserved for members. To delete an account, send an email to [email protected], specifying your email address and account details.

  9. What security measures have been adopted to protect my Personally Identifiable Information?

    Upon registration to the Site and creation of a profile, it is protected by a password. It is advisable not to share your personal password with anyone. It is also advisable to log out of your Marcom S.r.l. account and close the browser window at the end of each session. This, in fact, prevents others from accessing your Personally Identifiable Information. Marcom S.r.l. has adopted reasonable organizational, technical, and administrative measures to protect PII provided through the Site under its control. However, no online data transmission and no data storage system can be considered 100% secure. For this reason, Marcom S.r.l. cannot and does not guarantee the security of any information stored or transmitted by and to the user. Therefore, sending any sensitive information via email is not recommended. If the user has reason to believe that the security of the interaction system with Marcom S.r.l. has been compromised (for example, if they believe that the security of an active account may be compromised), they must promptly communicate any problem to Marcom S.r.l., by contacting the Company in accordance with this Privacy Policy (by choosing to contact Marcom S.r.l. by ordinary mail, response times will necessarily be extended).

  10. Where is my Personally Identifiable Information stored?

    The user's Personally Identifiable Information may be processed and stored in Italy, European Union. Hereby, the user accepts the transfer of any Personally Identifiable Information to Italy or any country other than their country of residence where Marcom S.r.l. or its licensees, agents or service providers provide services, process or store Personally Identifiable Information according to the terms of this Privacy Policy. Such countries may offer a different level of personal information protection than that of the user's country of residence. Marcom S.r.l. does not declare or offer any guarantee that the Site, or any part thereof, is suitable or available for use within a specific jurisdiction. Anyone who decides to access the Site does so on their own initiative and at their own risk and will assume full responsibility for compliance with all local laws, regulations, and norms. Marcom S.r.l. may choose, at any time and at its sole discretion, to limit, entirely or in part, the availability of the Site for any individual, geographical area, or jurisdiction.

  11. How long is my Personally Identifiable Information retained?

    Marcom S.r.l. will retain the user’s Personally Identifiable Information for as long as necessary to fulfill the purposes indicated in this Privacy Policy, unless otherwise required by law.
